1. Acceptance of Terms
By downloading, installing, or using CoffeeVibes (“the App”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and Raven Studios LLC (“Raven Studios,” “we,” “us,” or “our”), a Texas limited liability company. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility
You must be at least 13 years of age to use CoffeeVibes. Users between 13 and 17 must have verifiable parental or guardian consent. By using the App you represent that you meet these requirements. We do not knowingly permit accounts for children under 13 and will delete such accounts if discovered.
3. User Accounts
You may browse the App without an account. An account is required to access social features including check-ins, coffee crawls, meet-ups, and saving favorites. You may sign in with Google, Apple, or a magic link. We do not support passwords.
You are responsible for all activity that occurs under your account. You agree to notify us immediately at hello@coffeevibes.app if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable regulation
- Submit false, misleading, or fraudulent information, including fake check-ins or reviews
- Harass, threaten, impersonate, or intimidate other users or businesses
- Attempt to gain unauthorized access to any part of the App or its infrastructure
- Reverse engineer, decompile, or disassemble any portion of the App
- Scrape, crawl, or systematically collect data from the App without our express written permission
- Use automated tools, bots, or scripts to interact with the App
- Interfere with or disrupt the integrity or performance of our services
- Upload or transmit viruses, malware, or other malicious code
- Use the App to send spam, unsolicited messages, or promotional content
5. User Content
“User Content” means any content you submit to the App, including check-ins, drink ratings, reviews, photos, crawl data, and profile information. You retain ownership of your User Content.
By submitting User Content, you grant Raven Studios a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and create derivative works of that content in connection with operating and promoting the App. This license ends when you delete the content or your account, except where content has been shared with others who have not deleted it.
You represent and warrant that your User Content does not infringe any third-party intellectual property rights, violate any privacy rights, or contain illegal content. We may remove content that violates these Terms at our sole discretion, without notice.
6. Intellectual Property
The App, including its design, software, trademarks, service marks, logos, and all content created by Raven Studios (“CoffeeVibes Content”), is owned by Raven Studios LLC and protected by U.S. and international copyright, trademark, and other intellectual property laws. “CoffeeVibes” and the CoffeeVibes logo are trademarks of Raven Studios LLC.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. No other rights are granted.
7. Shop Data & Accuracy
Coffee shop information displayed in the App (including names, addresses, hours, photos, and busyness data) is sourced from third parties (including Foursquare Places and OpenStreetMap) and from user contributions. While we make reasonable efforts to keep this information accurate, we do not guarantee its completeness, timeliness, or accuracy.
Real-time busyness indicators are calculated from user check-in frequency and are estimates only. We are not responsible for decisions made based on shop data, including but not limited to travel to a location that is closed, inaccurate hours, or incorrect address information.
If you believe shop information is inaccurate, please report it through the App or contact us at hello@coffeevibes.app.
8. Subscriptions
CoffeeVibes Pro is a paid subscription available via Apple App Store and Google Play. Subscription billing, renewal, and cancellation are governed by the policies of the respective platform. We do not process subscription payments directly.
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. Pro features are available only while your subscription is active. Refunds are subject to the App Store or Google Play refund policies.
9. Termination
You may delete your account at any time through the App settings. We may suspend or terminate your access at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the App ceases immediately.
Sections 5, 6, 10, 11, 12, and 13 survive termination of these Terms.
10. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We do not endorse, verify, or guarantee any coffee shop listed in the App. Listings do not constitute recommendations by Raven Studios.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RAVEN STUDIOS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
12. Indemnification
You agree to indemnify, defend, and hold harmless Raven Studios LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
13. Dispute Resolution
Informal resolution. Before filing any formal claim, you agree to first contact us at hello@coffeevibes.app and attempt to resolve the dispute informally for at least 30 days.
Arbitration. If informal resolution fails, any dispute arising out of or relating to these Terms or the App shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), conducted in Dallas, Texas. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Exception. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
14. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas.
15. Changes to Terms
We may update these Terms at any time. When we make material changes, we will update the effective date above and notify you through the App or via email. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.
